Check 21 Legislation
The Check Clearing for the 21st Century Act, or Check 21, is a new federal law that will improve the efficiency and safety of the Nation's check payment system, and is effective October 28, 2004.
The purpose of Check 21 is to increase the speed of check clearing, lower check processing system clearing costs, and reduce the vulnerability of the check processing system to disruptions in air and ground transportation. The Check 21 law helps financial institutions send checks electronically to each other, speeding up the process by converting paper checks to electronic files. The law recognizes a new instrument called a "substitute check" which is a paper reproduction of an original check that contains an image of the front and back of the original check and is suitable for automated processing the same as the original. The substitute check is more than a photocopy; it's also required to meet strict technical standards to qualify as the legal equivalent of the original check. Changes you may notice due to Check 21:
- Checks may clear in hours instead of days
- If you request a copy of a check, you may receive a copy of the substitute check to fulfill your request.
- If you deposit a check into your checking or savings account, and the check is returned for non-sufficient funds, you will receive the check back in the form of a substitute check if, during the payment process, that check ever had been converted to an electronic file.
- If you use Online Banking, and view your checks through Check Imaging, you may be viewing substitute checks.
Since Check 21 will govern check processing, all financial institutions will be impacted.
If you request a substitute check, please read the Check 21 Disclosure.
